Filing 7 MINUTE ORDER. Plaintiff's motion for an extension of time to respond to the Court's September 23, 2021 Order (ECF No. #6 ) is GRANTED in part as follows. First, Plaintiff is granted a 30-day extension of time up to and including November 12, 2021 to respond to the Court's September 23, 2021 Order. Second, Plaintiff's request for a copy of his motion filed at ECF No. #3 is also granted. The Clerk of the Court shall mail to Plaintiff at his address of record, one copy of the motion filed at ECF No. #3 . Filing 4 ORDER. It is ORDERED that Mr. Mercer cure the deficiencies designated within thirty (30) days from the date of this order. It is FURTHER ORDERED that Mr. Mercer pay the $402.00 filing fee in full in advance. If he wishes to request leave to proceed in forma pauperis, he must obtain (with the assistance of his case manager or the facility's legal assistant) the Court-approved form for filing a Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915, along with the applicable instructions, at www.cod.uscourts.gov, and shall use the form in curing the designated deficiencies. Plaintiff also must demonstrate why he should not be denied leave to proceed pursuant to 28 U.S.C. 1915(g). It is FURTHER ORDERED that, if Mr. Mercer fails to cure the designated deficiencies within thirty days from the date of this order, the complaint and the action will be dismissed without further notice.
