The Clerk of the Court is directed to mail one copy of the following court approved forms to Ms. Talty, along with all applicable instructions: (1) Prisoner Complaint, (2) Prisoners Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915, (3) Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 (3) Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. 1915 in a Habeas Corpus Action. Ms. Talty shall use the appropriate forms to proceed in this action. Ms. Talty is reminded that if she is challenging a pending criminal proceeding in state court, the proper action is a habeas corpus action filed pursuant to 28 U.S.C. 2241 using the Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. 2241 form. If Ms. Talty is challenging her treatment during her confinement, the proper action is filed pursuant to 42 U.S.C. 1983 using the Prisoner Complaint form. She may not file a 2241 action and a 1983 action in the same case. Ms. Talty is granted an extension to November 11, 2022, to comply with the #3 Order Directing Ms. Talty to Cure Deficiencies.
