October 30, 2024 Opinion or Order Filing 22 MINUTE ORDER: Before the Court is another ambiguous filing by Plaintiff. ECF #21 . As Plaintiff is proceeding in this case pro se, the Court should construe his filings liberally. See Haines v. Kerner, 404 U.S. 519, 52021 (1972); Hall v. Bellmon, 935 F.2d 1106, 1110 (10th Cir. 1991). However, the Court should not be an advocate for a pro se litigant. See Hall, 935 F.2d at 1110. Plaintiff filed a document titled "Minute Order" and attached the Court's Minute Order setting the Scheduling Conference at ECF #11 . ECF #21 . It appears to the Court that Plaintiff was attempting to abide by the Court's mandate in its Minute Order that "Plaintiff shall notify all Parties who have not entered an appearance of the date and time of the Scheduling Conference." ECF #11 at 1. If that is indeed Plaintiff's intention, it is insufficient. The defendant in this case has not yet entered its appearance, and as such, cannot be assumed to be familiar with anything filed on the Docket in this case. October 28, 2024 Opinion or Order Filing 18 MINUTE ORDER: This matter comes before the Court on several recent filings by Plaintiff. ECFs #9 , #14 , #17 . First, Plaintiff filed on the Docket a letter, a seemingly unexecuted summons, and a blank proof of service, all of which were issued to him by the District's Clerk of Court. ECF #9 . It is unclear to the Court why Plaintiff filed these on the Docket; those items were provided by the Clerk for Plaintiff's own use in litigating his case. Indeed, the letter explains that the Court "encourage[s] you to serve your summons and complaint promptly, and file your return of service with the court." Id. Here, the documents Plaintiff filed do not seem to indicate that Plaintiff has in fact served the summons and complaint. Id. Plaintiff is reminded that it is his own responsibility to serve Defendant in accordance with the Federal Rules of Civil Procedure. Second, Plaintiff filed a "Motion to Remand this Case Back to the EEOC." ECF #14 . Accordingly, the Court denies the Motion. Id. Third, Plaintiff filed a "Notice of Scheduling Conference." ECF #17 . The Notice purports to inform the Court that Plaintiff "will be connected remotely" for the Scheduling Conference set for December 19, 2024. However, this Notice is improper, and the Court will not grant such relief based on it. Finally, Plaintiff is reminded that, as mentioned above, the Court has set his case for an in-person Scheduling Conference on December 19, 2024. October 16, 2024 Opinion or Order Filing 8 ORDER REFERRING CASE: This case is referred to Magistrate Judge Michael E. Hegarty for all motions. Pursuant to 28 U.S.C. 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ.
