Filing 7 ORDER (see attached) - In order to determine whether it has subject matter jurisdiction in this action, the Court ORDERS Plaintiffs to supplement the record on or before Thursday, July 11, 2013 by providing an affidavit regarding their domiciles at the time their Complaint in this action 1 was filed i.e., June 14, 2013 as well as stating whether either of them maintained any other residence in any other state at the time at which the Complaint was filed, along with (1) the location of all s uch residences kept; and (2) the approximate length of time spent at each such residence. The Court further ORDERS Plaintiffs to state in detail within their affidavit the source and grounds for their information and belief regarding (1) Defendant G riffin Hospital's place of incorporation and Defendant Griffin Hospital's principal place of business at the time Plaintiffs' Complaint was filed; and (2) the domicile of Defendant Cynthia M. Ronan, M.D. at the time Plaintiffs' Co mplaint was filed. All case deadlines shall be stayed pending the Court's review of Plaintiffs' affidavit. If, upon review, the Court determines that it possesses subject matter jurisdiction, the action may proceed. Otherwise, in the abs ence of such jurisdiction, the Court shall dismiss the action without prejudice. Alternatively, at any time prior to Thursday, July 11, 2013 Plaintiffs may file a notice of voluntary dismissal under Fed. R. Civ. P. 41(a)(1). Such dismissal would also be without prejudice.(Hornstein, A) |
