For substantially the reasons stated in CHLIC's objection (Doc. #411 ), the Court DENIES plaintiffs' motion to amend the scheduling order to permit the filing of an amended class certification motion (Doc. #407 ). The Court concludes that the filing of an amended class certification motion is not consistent with the parties' stipulation (Doc. #260 ), that there is not "good cause" shown to amend the scheduling order, that any amended class could and should have been proposed at an earlier time, that there is still uncertainty about the scope of the proposed amended class, and that CHLIC would be unfairly prejudiced. In so ruling, the Court recognizes its discretion to amend the schedule and to allow another class certification motion but concludes for the reasons stated by CHLIC that the equities do not weigh in favor of plaintiffs' motion. Even accepting the plaintiffs' evidence that CHLIC was aware of its wrongdoing, this does not mean that the wrongdoing is susceptible to adjudication by means of a class action on the terms proposed by the plaintiffs. "Good cause is established by demonstrating a clearly defined and serious injury resulting from disclosure....Broad allegations of harm will not establish good cause; rather, to establish good cause under Rule 26(c), courts require a particular and specific demonstration of fact, as distinguished from stereotyped and conclusory statements." Hanson v. U.S. Airports Air Cargo, LLC, No. 3:07CV353 (JCH)(HBF), 2008 WL 4426909, at *1 (D. Conn. Sept. 26, 2008) (internal citations and quotations omitted). Further, under Local Rule 5(e)(3), sealing must be supported by "clear and compelling reasons" and "narrowly tailored to serve those reasons." D. Conn. L. Civ. R. 5(e)(3). Accordingly, plaintiffs' Motion to Seal [ECF No. 316] is GRANTED in part and DENIED in part as set forth in detail below. Filing 336 ORDER RE DEPOSITION OF DAVID CORDANI. In accordance with the Court's oral ruling following the hearing today, the Court overrules defendant CHLIC's objection to the deposition of Cigna CEO David Cordani. The parties do not appear to dispute the governing legal principles that allow for the deposition of a top corporate executive but subject to protections against the possibility that an adverse party may improperly seek to depose a top corporate executive for reasons of leverage or harassment and without a good faith basis to believe that the executive has material and non-cumulative knowledge of facts of significance to the litigation. See, e.g., Scott v. Chipotle Mexican Grill, Inc., 306 F.R.D. 120, 122-23 (S.D.N.Y. 2015) (discussing applicable principles). The Court concludes that plaintiffs have established sufficient and good faith reasons to depose Mr. Cordani in light of the document identifying him as project sponsor for the "Pharmacy Over Payments" project for Argus Transition, in light of the deposition testimony of Chris Hocevar who directly reported to Mr. Cordani and suggesting the possibility of Mr. Cordani's knowledge of the alleged scheme, and in light of the overall financial significance of the alleged scheme involving $100 million of payments to the company. There is even one document from Mr. Hocevar to Mr. Cordani among others that refers to "claw back mechanism currently being assessed." I am satisfied that the plaintiffs have made an adequate showing to suggest that Mr. Cordani may have non-cumulative knowledge of facts integral to the alleged scheme and that his knowledge as company leader is highly significant to plaintiffs' liability claims. I am not convinced that plaintiffs seek to depose Mr. Cordani for improper reasons of harassment. Nor am I convinced that plaintiffs must first depose other senior executives named by CHLIC before seeking to depose Mr. Cordani.
