RULING granting 35 Motion to Dismiss; granting 33 Motion to Dismiss. The Amended Complaint is DISMISSED. To the extent that Count Two is based on the argument that the state courts Restitution Order is unenforceable for reasons unrelated to the discharge injunction, Count Two is dismissed with prejudice. To the extent that Counts One and Two are based on a violation of the discharge injunction, Counts One and Two are dismissed without prejudice to the plaintiff moving to reopen his case before the Bankruptcy Court in order to seek appropriate relief there.
