P., but striking certain specified claims from Plaintiff's 18 Amended Complaint for failing to state claims upon which relief may be granted, 28 U.S.C. § 1915A. (See contents of Ruling as to stricken claims.) Upon entry of this Ruling, the Clerk is directed to file Plaintiff's 18 Amended Complaint as a separate en try on the case docket. INITIAL REVIEW ORDER (see attached). Upon the Court's review of Plaintiff's Complaint pursuant to 28 US.C. § 1915A, the case may proceed only on the following federal claims: Eighth Amendment claim for "excessive force" again st Phillips, Eighth Amendment claim for "failure to protect" from harm against Nunez, and Eighth Amendment hazardous "conditions of confinement" claim against Watson. Each federal claim is permitted against the defendant solely in his individual capacity for money damages. Abrams's state law claims of assault, battery, and intentional infliction of emotional distress may proceed against Phillips in his individual capacity for damages.
