Filing 8 ORDER DISMISSING CASE. Appellant's #1 Notice of Appeal is untimely under Fed. R. Bankr. Proc. 8002(a)(1), which requires a notice of appeal to be filed "within 14 days after entry of the judgment, order, or decree being appealed." "[T]he time limit contained in Rule 8002(a) is jurisdictional, and... in the absence of a timely notice of appeal in the district court, the district court is without jurisdiction to consider the appeal" even when the litigant is pro se. In re Seimon, 421 F.3d 167, 169 (2d Cir. 2005); see also Chaturvedi v. O'Connell, 335 Fed. Appx. 145, 146 (2d Cir. 2009); In re B.A.R. Entm't Mgmt., Inc., 414 Fed. Appx. 310, 310-11 (2d Cir. 2010). The order Appellant is appealing was entered by the Bankruptcy Court on 7/27/2018 and, under Rule 8002(a)(1), Appellant had until 8/10/2018 to file her Notice of Appeal. Appellant missed that deadline. Accordingly, her Notice of Appeal was untimely filed, and this Court lacks jurisdiction over her appeal. The Clerk is directed to close this case. Signed by Judge Vanessa L. Bryant on 8/23/2018. (Bryan, Kelsey) |
