Filing 14 MOTION to Consolidate Cases by Anthony Villano. Responses due by 5/1/2019. (Fanelle, N.) |
Filing 13 ORDER. Anthony Villano attempted to file this action pro se on behalf of the Plaintiffs on February 27, 2019. On March 20, 2019, the Complaint was rejected. (ECF No. 7.) It is well established that an artificial entity cannot proceed pro se and any person who represents an artificial entity must "be an attorney licensed to practice law before our courts," which Mr. Villano is not. Jones v. Niagara Frontier Transp. Auth., 722 F.2d 20, 22 (2d Cir. 1983). In the Court's March 20, 2019 order, the Plaintiffs and Mr. Villano were informed of this requirement and further notified that this case would be dismissed if counsel did not appear on or before April 3, 2019. (ECF No. 7.) Yet, counsel has failed to appear on behalf of the Plaintiffs as required by the Court's Order. Accordingly, this action is hereby dismissed. The Clerk is directed to close this matter. Signed by Judge Kari A. Dooley on 4/4/2019.(Beyerlein, Alexis) |
Filing 12 ORDER denying #2 Motion for Order. His representation to the contrary notwithstanding, Mr. Villano is not a named Plaintiff. He cannot appear on behalf of the named entity Plaintiffs. See ECF 7.Signed by Judge Kari A. Dooley on 3/22/19. (Dooley, Kari) |
Filing 11 ORDER finding as moot #9 Motion to Quash. See ECF No. 10. Signed by Judge Kari A. Dooley on 3/22/2019. (Beyerlein, Alexis) |
Filing 10 ORDER. The Complaint in this matter was rejected insofar as the two named Plaintiffs, as Trust entities, cannot file a complaint without appearing counsel. Legal entities cannot appear pro se. Any subpoenas purportedly issued on behalf of the Plaintiff entities are, sua sponte, quashed. In addition, Mr. Villano is not a named plaintiff in this action. He therefore has no authority to issue subpoenas. Any subpoenas purportedly issued on behalf of Mr. Villano individually are also, sua sponte, quashed. Signed by Judge Kari A. Dooley on 3/22/2019.(Beyerlein, Alexis) |
