May 10, 2019 Opinion or Order Filing 7 ORDER DISMISSING CASE. Appellant moves this District Court for an extension of time to file an appeal from the dismissal of her bankruptcy case. She moves "pursuant to Rule 8002(a)(d)(1)(B)". No such rule exists. However, Federal Rule of Bankruptcy Procedure 8002(d)(1)(B) provides "[e]xcept as provided in subdivision (d)(2) [specifying when an extension may not be granted], the bankruptcy court may extend the time [prescribed by this rule] to file a notice of appeal upon a party's motion that is filed: (B) within 21 days after that time, if the party shows excusable neglect." Accordingly, Appellant's #2 MOTION for Leave to Appeal is denied as it must be made to the Bankruptcy Court. As the appeal appears untimely, it is DISMISSED without prejudice to timely refiling together and in accordance with an extension granted by the Bankruptcy Court. Signed by Judge Vanessa L.
