While defendant is correct that the possibility of yet-to-be-added defendant who might destroy diversity jurisdiction is not a ground to remand/destroy jurisdiction, it is mistaken about plaintiffs ability under Fed.R.Civ.P. 41(a)1 to notice his dismissal unilaterally so long as the defendant has not answered or moved for summary judgment. See Fed.R.Civ.P. 41(a)(1)(A)(i).Thus, treating the Motion as a Notice, it is granted, and the case is dismissed without prejudice. See id. at 41(a)(1)(B). SO ORDERED by Judge Janet C.
