Filing 8 ORDER re: request to issue summons. Counsel for plaintiff has requested that the Clerk issue a summons to the Commissioner of Social Security. That request is denied, as moot. As the Standing Scheduling Order indicates, a summons is not necessary: "Service of Complaint. In lieu of service of process of the Complaint and related documents, the Clerk of the Court shall provide service via the Court's CM/ECF system to the Commissioner of Social Security by electronically serving it on the Social Security Administration's Office of the General Counsel and the United States Attorney's Office for the District of Connecticut. If this process is followed, the Defendant has agreed that it will constitute adequate service of process." Doc. #3 at 2. The Complaint was in fact served on the Commissioner in this manner on August 10, 2020, and a copy of the Complaint was emailed to the relevant offices. Filing 7 ORDER. On August 11, 2020, plaintiff was ordered "to show cause why this case should not be dismissed for failure to pay the filing fee or file a Motion to Proceed in forma pauperis." Doc. #5. Plaintiff has filed a response to the Court's Order to Show Cause on August 13, 2020, explaining the reasons for the delay in making payment, and asserting that the filing fee has now been paid. See Doc. #6 at 2. Plaintiff's response is accepted, and the case will proceed. The Court notes that, in the future, counsel should simply request an extension of time in such extraordinary circumstances. Without an explanation or motion for extension, the Court had no way of knowing why the required fee was not paid when the Complaint was filed, thus necessitating the issuance of the Show Cause order. Plaintiff is hereby ORDERED to show cause why this case should not be dismissed for failure to pay the filing fee or file a Motion to Proceed in forma pauperis. Plaintiff shall file a response to this Order to Show Cause by Friday, August 14, 2020. Failure to respond to this Order will result in dismissal of this matter. It is so ordered.
