Filing 5 ORDER. The plaintiff's motion to continue proceedings for sixty days, [ECF No. 4], is GRANTED. In view of this order, the motion for leave to file, [ECF No. 1], is DENIED without prejudice to refiling together with either the filing fee in the amount of $400.00 or a prisoners application to proceed in forma pauperis and a proposed amended civil rights complaint. The plaintiff filed the supplemental complaint, [ECF No. 3], which lists attorney Kelly M. Barrett as a new defendant, without a motion seeking leave to do so as required by Fed. R. Civ. P. 15(d). In conjunction with a supplemental complaint, the plaintiff filed a motion to dismiss the claims asserted against attorney Barrett with prejudice. Accordingly, the clerk shall STRIKE the supplemental complaint, [ECF No. 3], from the docket. The motion to dismiss, [ECF No. 2], the claims asserted against attorney Barrett is DENIED as moot.
