November 5, 2021 Opinion or Order Filing 40 ORDER GRANTING IN PART PLAINTIFF'S MOTION FOR EXTENSION OF TIME TO RESPOND TO THE DEFENDANTS' MOTION TO DISMISS (Doc. #37 ). Plaintiff has moved for a 120-day extension of time to respond to defendants' motion to dismiss for lack of personal jurisdiction (Doc. #32 ). Plaintiff asserts that the Court "may need to go outside the pleadings to resolve the personal jurisdiction question raised by the defendants' Motion to Dismiss." Doc. #37 at 1. Plaintiff further asserts that jurisdictional discovery is necessary in order to give plaintiff an opportunity to "adequately investigate the defendants' challenge to jurisdiction" and to "establish[] a nexus between the defendants' conduct and its connections to Connecticut beyond publicly available information pre-discovery." Id. at 2. Defendants oppose plaintiff's request for a 120-day extension of time and assert that, to the extent that jurisdictional discovery may be necessary, all such discovery can be completed within 30 days. Doc. #40 at 3. The filings appear to raise potentially relevant factual questions related to defendants' contacts in the forum state. The Court notes, however, that plaintiff has not specified with detail what private information belonging to defendants he seeks, how it will assist him in establishing the Court's personal jurisdiction over the defendants, or why such information justifies 120 days of discovery. Accordingly, the Court will grant in part plaintiff's motion for an extension of time to the extent that the plaintiff may have an additional 30 days to conduct jurisdictional discovery and respond to defendants' motion to dismiss. Plaintiff shall file any response to defendants' motion to dismiss (Doc. #32 ) no later than December 8, 2021. If plaintiff has grounds to seek an extension of time of more than 30 days, plaintiff shall file no later than November 12, 2021 a renewed motion explaining what information plaintiff seeks, how it is relevant to defendants' jurisdictional challenge, the length of the requested extension, and why the information sought justifies an extension of the period of time requested. Defendants shall file any objection or other response to such renewed motion no later than November 17, 2021. The parties are encouraged in the meantime to discuss the scope of necessary jurisdictional discovery and to see if they might reach agreement without the need for continued litigation of extension requests. All discovery shall be completed by March 1, 2023. Any dispositive summary judgment motions shall be filed by May 1, 2023, and any response to dispositive summary judgment motions shall be filed by June 1, 2023. The parties' joint trial memorandum is due by September 1, 2023, or within 30 days of the Court's ruling on dispositive summary judgment motions, whichever date is later. The Court will thereafter set a trial date, and the parties should be prepared to proceed to jury selection within 30 days of the filing of the joint trial memorandum. Please refer to Judge Meyer's webpage on the District of Connecticut website for Judge Meyer's "Instructions for Discovery Disputes" and "Instructions for Joint Trial Memorandum" and "Pretrial Preferences" and "Trial Preferences."
