Filing 6 ORDER. Pursuant to Federal Rule of Civil Procedure 12(h)(3), if the Court determines at any time that it lacks subject-matter jurisdiction, the Court must dismiss the action. Generally, a federal district court may exercise subject matter jurisdiction over a civil action only if there is federal question jurisdiction, applicable to all civil actions arising under the Constitution, laws, or treaties of the United States, or if there is diversity jurisdiction, which requires diversity of citizenship and an amount in controversy exceeding $75,000, exclusive of interest and costs. 28 U.S.C. 1331, 1332(a). The statutes referenced in the complaint under which this action is allegedly brought are criminal laws. Criminal cases can be pursued in federal court only by the United States Attorney, not by private citizens. To pursue an action for tax fraud or identity theft, Plaintiff may file a complaint with the United States Attorney. The complaint does not establish civil subject matter jurisdiction, either through federal question jurisdiction or diversity jurisdiction. The Court therefore DISMISSES this action without prejudice to re-filing. If Plaintiff wishes to pursue this case, she must file an amended complaint that adequately establishes that the Court has subject matter jurisdiction. The amended complaint must be filed on or before May 11, 2022. If no amended complaint is filed by that date, the Clerk is directed to close this case.Signed by Judge Sarala V. Nagala on 04/11/2022.
