July 6, 2022 Opinion or Order Filing 8 ORDER re: #2 Motion for Leave to Proceed In Forma Pauperis. The plaintiff has filed suit on behalf of her minor child. Her in forma pauperis application includes a statement of her own financial resources, but it does not include a statement of the child's own financial resources, if any. Courts consider such resources when reviewing in forma pauperis applications in cases brought by parents on behalf of their children. See, e.g., Zhu v. Countrywide Realty, 148 F. Supp. 2d 1154, 1156 (D. Kan. 2001); Bryant v. Whalen, No. 88 C 4834, 1992 WL 198946, at *5 N.D. Ill. Aug. 12, 1992). Additionally, her application says that she receives financial assistance from family members in meeting her monthly expenses. In that situation, courts consider the resources of those family members in evaluating in forma pauperis applications. See, e.g., Fridman v. City of New York, 195 F. Supp. 2d 534, 537 (S.D.N.Y. 2002).The plaintiff is directed to file, by July 20, 2022, another in forma pauperis application containing a statement of her child's financial resources, and also the resources of any family member from whom she draws regular financial support. In the alternative, the plaintiff may pay the filing fee. The plaintiff is respectfully advised that if she neither pays the filing fee nor submits the additional in forma pauperis application by July 20, 2022, her case may be dismissed.
