Date Filed Document Text
September 23, 2022 Filing 21 AMENDED COMPLAINT against All Defendants, filed by George Berka.(Berka, George)
September 20, 2022 Filing 20 NOTICE. All parties are advised that they may elect to consent to the jurisdiction of a United States Magistrate Judge. United States Magistrate Judges do not conduct felony criminal trials; as a result, parties are often able to schedule a jury trial before a Magistrate Judge sooner and with more flexibility than a jury trial before a District Judge. If all parties consent to the jurisdiction of a United States Magistrate Judge, the parties should complete and file the attached consent form. If any party does not consent, that information should not be conveyed to the Court, and no consent form should be filed. The Court notes that ordinarily, where the parties consent to the jurisdiction of a Magistrate Judge, any Magistrate Judge who has previously been involved in confidential settlement discussions would not be assigned to hear the trial. Signed by Judge Sarah A. L. Merriam on 9/20/2022.(Caffrey, A.)
September 12, 2022 Opinion or Order Filing 19 ORDER. Plaintiff has filed a submission indicating that he "asks to be permitted to amend his complaint[.]" Doc. #18 at 3. Ordinarily, a plaintiff seeking to amend the Complaint must comply with Local Rule 7(f). However, in the interest of efficiency, and in light of the early stage of this litigation and the fact that neither defendant has yet appeared, the Court grants plaintiff leave to file an Amended Complaint.Plaintiff shall file an Amended Complaint, which must establish subject matter jurisdiction and personal jurisdiction over all named defendants, on or before October 1, 2022. Plaintiff is advised that the Amended Complaint will completely supersede, that is, replace, the original Complaint. The original Complaint will be of no effect once the Amended Complaint is filed, and may not be incorporated by reference into the Amended Complaint. The Amended Complaint must comply fully with the Federal and Local Rules. The Rules are available on the Court's website at https://ctd.uscourts.gov/court-info/local-rules-and-orders. In particular, plaintiff's attention is directed to Rules 8, 9, 10, and 11, of the Federal Rules of Civil Procedure, and Rule 10 of the Local Rules of Civil Procedure. It is so ordered. Signed by Judge Sarah A. L. Merriam on 9/12/2022. (Powers, L.)

Plaintiff shall file his response to the Court's Order to Show Cause (Doc. #15 ) on or before October 3, 2022. As the Order to Show Cause makes clear, the Court is concerned that it may lack subject matter jurisdiction in this matter. It is plaintiff's obligation to establish subject matter jurisdiction. Accordingly, the Court does not expect to grant any further extensions of this deadline. Neither defendant is required to file any response to the Complaint until after the Court has received plaintiff's response to the Order to Show Cause. It is so ordered. Signed by Judge Sarah A. L. Merriam on 8/26/2022. (Teague, J.)
