Filing 49 ORDER GRANTING MOTION TO STAY REMAND (Doc. #45 ). The Court has discretion to grant a stay pending appeal in light of its consideration of the following four factors: "(1) whether the stay applicant has made a strong showing that he is likely to succeed on the merits; (2) whether the applicant will be irreparably injured absent a stay; (3) whether issuance of the stay will substantially injure the other parties interested in the proceeding; and (4) where the public interest lies." Nken v. Holder, 556 U.S 418, 434 (2009). As to the first factor, although I adhere to my view of the merits with respect to granting the motion to remand, I think the defendants have good faith grounds to seek appellate review because there is a reasonable likelihood that a panel of the Second Circuit could view the remand issue differently than I have. As to the second factor, irreparable harm could result if I were to remand the case prior to the completion of appellate review in the absence of a clear procedural mechanism for restoration of the case to my docket in the event that a panel of the Second Circuit decides to reverse my order of remand. As to the third factor, because of the expedited nature of appellate review in this context, there appears to be little prejudice to the plaintiffs from maintaining the status quo for the duration of the expedited appellate process. As to the fourth factor, the public interest weighs in favor of allowing a party the opportunity for appropriate appellate review before a final and potentially irrevocable determination of its rights with respect to the choice of forum where the litigation shall proceed. Accordingly, the Court in its discretion GRANTS the motion to stay its order of remand until the conclusion of the Second Circuit's review and determination. It is so ordered.
