August 14, 2022 Opinion or Order Filing 3 ORDER. The court orders that the movant show cause on or before August 29, 2022 why this action should not be dismissed for failure to state a claim. "Article III, Section 2 of the Constitution limits the subject matter jurisdiction of the federal courts to the resolution of cases and controversies." Town of Babylon v. Fed. Hous. Fin. Agency, 699 F.3d 221, 228 (2d Cir. 2012). The movant construes this as a "Motion to move the court for decision to settle/Claim minor Estate." As such, it does not conform to pleading requirements and on its face does not present a federal question. "The presence or absence of federal-question jurisdiction is governed by the well-pleaded complaint rule, which provides that federal jurisdiction exists only when a federal question is presented on the face of the plaintiff's properly pleaded complaint." Caterpillar Inc. v. Williams, 482 U.S. 386, 392 (1987) (internal quotation marks omitted). "After examining only those allegations which are properly raised in a well-pleaded complaint, the court must then determine whether the substance of those allegations raises a federal question." D'Alessio v. New York Stock Exchange, Inc., 258 F.3d 93, 100 (2d Cir. 2001) (internal quotations omitted).
