Filing 8 ORDER TO SHOW CAUSE WHY COMPLAINT SHOULD NOT BE DISMISSED. Pursuant to 28 U.S.C. 1915(e)(2)(B), the Court may review a complaint sua sponte to determine if it is frivolous or malicious, fails to state a claim for which relief may be granted, or seeks monetary relief against a defendant who is immune from such relief. In order to state a claim, a complaint must allege sufficient facts to establish plausible grounds for relief. See Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009). Plaintiff has filed a complaint naming the IRS Appeals Office as a defendant, to which he has attached what appears to be a letter from the IRS that explains how to file appeals and protests with the agency. But he has not included any facts showing how the IRS violated his rights, nor has he explained what remedy he seeks. Thus, the complaint in its current form fails to state a claim. If plaintiff has good faith grounds for his suit, he may file by July 9, 2024 an amended complaint that alleges facts supporting his claim. In the absence of the filing of an amended complaint alleging facts to show plausible grounds for relief, the Court is likely to dismiss this action. It is so ordered. Signed by Judge Jeffrey A.
