Filing 13 ORDER. The Court has reviewed the proofs of service Plaintiffs have provided as to the United States Citizenship and Immigration Services, United States Attorney General, and United States Attorney's Office. ECF No. #12 .Because Defendant United States Citizenship and Immigration Services is an agency of the United States, it must be served in accordance with Federal Rule of Civil Procedure 4(i)(2). According to Fed. R. Civ. P. 4(i)(2), to effect service on an agency of the United States, "a party must serve the United States and also send a copy of the summons and of the complaint by registered or certified mail to the agency." In turn, to properly serve the United States, service must be made in accordance with Fed. R. Civ. P. 4(i)(1), which specifically requires "deliver[ing] a copy of the summons and of the complaint to the United States attorney for the district where the action is brought." Upon review of the proof of service for the United States Attorney's Office, Plaintiffs have improperly served the United States Attorney's Office via certified mail rather than personal service. See Basovitch v. U.S., No. CV-90-1969 (CBA), 1991 WL 148501, at *2 (E.D.N.Y. July 19, 1991) (holding that it is "well-settled that the delivery requirement" to the United States Attorney in Rule 4 "requires personal service").Accordingly, service is defective on Defendant. Plaintiffs must properly serve the United States Attorney's Office and file proof of such service within seven days of its receipt. See Local Rule 4(d). Signed by Judge Sarala V.
