March 14, 2025 Opinion or Order Filing 17 ORDER granting ECF No. #15 , Consent Motion to Remand to State Court. Section 1445(c) of Title 28 of the United States Code dictates that state court civil actions "under the workmen's compensation laws of such State may not be removed to any district court of the United States." Here, Plaintiff brings a claim under Conn. Gen. Stat. 31-290a. As acknowledged by the parties in their motion, ECF No. 15 at 23, this court has held that Conn. Gen. Stat. 31-290 falls under Connecticut's workmen's compensation laws, therefore 1445(c) prohibits the removal from state court of any claim under 31-290. See Wilson v. Lowe's Home Ctr., Inc., 401 F. Supp. 2d 186, 192 (D. Conn. 2005) ("the cause of action provided by 31290a is an integral part of Connecticut's scheme, [thus] it must be concluded that plaintiff's claim is within the scope of 1445(c)"). In light of the parties' desire to litigate this matter in one forum, and in the interest of judicial economy, the court declines to exercise pendent jurisdiction over Plaintiff's other state law claims and grants the parties' motion.
