February 14, 2025 Opinion or Order Filing 4 ORDER re: Case Filing. Proceeding pro se, Ms. Julie Lawrence Greco has filed a "Suit at Common-Law with Common-Law Jury Demand." (ECF No. 1.) She also filed a document entitled "Notice to Court Clerk," in which she insists that her suit is "not a civil action" and therefore should not be assigned a case number with the letters 'CV' imbedded therein." (ECF No. 2.) The Clerk of the Court initially docketed the case as a miscellaneous, or "MC," action. The Clerk also assigned the case to the undersigned Magistrate Judge, because Magistrate Judges are authorized by statute to preside over certain miscellaneous proceedings. See 28 U.S.C. 636.Having reviewed the plaintiff's "Suit at Common Law," however, it is clearly a civil action and not a miscellaneous action. Miscellaneous actions "are ancillary and supplementary proceedings." In re Varholy, No. 3:23-mc-00004 (MEG), 2023 WL 4236044, at *1 (D. Conn. June 28, 2023) (citing Admin. Office of U.S. Courts, District Clerks Manual, 4.03.a.1). These proceedings include such things as registrations of judgments obtained in other districts, motions to quash deposition subpoenas, applications to perpetuate testimony, and so forth. Id.; see also Admin. Office of U.S. Courts, District Clerks Manual, 4.03.a.1 (identifying fifteen matters for assignment of miscellaneous case numbers). "When a plaintiff seeks an award of damages or an injunction against another person, [her] action is a civil action, not a miscellaneous action. Lewis v. DOC's U.S. State of Connecticut, Inc., No. 3:23-mv-00116 (VDO), 2024 WL 5088764, at *2 (D. Conn. Mar. 20, 2024). In this case, Ms. Greco contends that she was wronged by a local government official, and she seeks $1,400,000 in damages plus "any other damages or sanctions deemed appropriate by a jury upon the finding of other facts." (ECF No. 1, at 8.) She does not seek to register an out-of-district judgment, quash a subpoena, or accomplish any other things that are properly regarded as miscellaneous actions. Her case is therefore a civil action, however much she may wish to contend otherwise.Because the case is a civil action, the undersigned Magistrate Judge should not be the presiding judge unless the parties consent, see 28 U.S.C/ 636, and it is clear that the plaintiff does not consent. (ECF No. 1, at 7.) Accordingly, the Clerk of the Court is respectfully directed to give this case a CV number and assign it to a District Judge. It is so ordered. Signed by Judge Thomas O.
