ORAL ORDER: The Court, having reviewed Plaintiff's request that Defendant be required to produce source code for the accused product as part of Defendant's core technical document production, and having heard argument on the issue at the recent Case Management Conference and at the November 20, 2018 hearing, hereby DENIES Plaintiff's request. It is not clear to the Court that the documents that Defendant intends to produce by the core technical document deadline will be insufficient to enable Plaintiff to "determine how the accused... product works[,]" (D.I. 37 at 2), or that those documents will render Plaintiff unable to prepare sufficiently-detailed initial infringement contentions. Source code will need to be produced in the case so long as any patent claims are pending, and the pendency of the motion to dismiss is not a sufficient reason for Defendant to resist production of source code, (see D.I. 37 at 2-3). With this order, all the Court is doing is determining that it will not require such production be made by the core technical document production deadline of December 3, 2018. The parties should continue to meet and confer on how and when source code will be made available to Plaintiff, and if they cannot reach agreement on the issue, they may utilize the Court's discovery dispute procedures.
