May 22, 2023 Opinion or Order Filing 47 ORAL ORDER, The Court sets this matter for a telephonic hearing on 5/23/2023 at 9:15 AM Central time (10:15 AM Eastern time) to discuss the parties' proposal for severance of certain claims as well as the time limits for the upcoming trial. In addition: (1) Plaintiffs' motion to compel in camera inspection 410 is granted. Due to the Court's travel schedule defendants are directed to send to Judge Kennelly's proposed order e-mail address on 5/22/2023 an e-mail including as separate attachments the redacted and unredacted versions of Harries deposition exhibit 17. (2) The parties' proposed voir dire submission is sufficient and is adopted by the Court. (3) Defendants have moved for reconsideration of the predecessor judge's order under 35 USC 295 shifting to defendants the burden of proof on infringement regarding claims 8-10; 13; and 15 of the 578 patent. Plaintiffs first argue "law of the case." That argument borders on the frivolous; the law of the case doctrine does not under any stretch of anyone's imagination preclude a court from reconsidering an earlier ruling when appropriate. Plaintiffs' second argument is that they cannot find a case in which such reconsideration was granted and that therefore reconsideration is inappropriate. This argument is likewise entirely devoid of merit. There is nothing in the text or caselaw under section 295 that exempts rulings under that section from reconsideration under appropriate circumstances. To put it another way there is nothing in or concerning section 295 that indicates that rulings under it have some sort of special status that insulates them from being revisited if circumstances change. All of that said defendants have not persuaded the Court that circumstances have changed in a material way since the predecessor judge made the section 295 ruling. The Court agrees with plaintiffs that the additional inspections/discovery that have taken place since then do not materially alter the state of affairs that existed at the time of the predecessor judge's ruling. For this reason the Court denies defendants' motion to place the burden of proof of infringement upon plaintiffs 400 . Ordered by Judge Matthew F Kennelly on 5/22/2023.
