December 11, 2018 Opinion or Order MINUTE ORDER: The Court held a teleconference on the record with Plaintiffs' counsel on December 11, 2018, that focused on the Court's instructions for Plaintiffs' proposed findings of fact and conclusions of law, which are due by FEBRUARY 26, 2019. Based on the use of certain exhibits at trial, at Plaintiffs' request the Court also admitted exhibits PX-61, which is an excerpt of a Hezbollah training video, and PX-122, which is a video of an interview with Abu Mahdi al-Muhandis. Also at Plaintiffs' request, the Court now admits exhibit PX-63, which is a compendium of U.S. Central Command SIGACT Reports that evidently are referenced in Plaintiffs' expert reports. November 5, 2018 Opinion or Order MINUTE ORDER: The Court held a Pretrial Conference on November 5, 2018, in anticipation of the Phase I proceedings from December 3-5, 2018. The Court discussed a number of topics with Plaintiffs' counsel. Some of those topics may warrant further pretrial submissions, as provided for below. First, Plaintiffs indicated that they intend to file an updated exhibit list, which they may do by NOVEMBER 13, 2018.Second, by NOVEMBER 20, 2018, Plaintiffs shall identify any exhibits for which they seek admission into evidence before trial, together with the legal basis therefor. If Plaintiffs want to introduce expert reports into evidence, whether before or during trial, then any submission regarding exhibits shall identify the authority for such admission, particularly in cases in default posture.Third, the Court discussed Plaintiffs' intention to request judicial notice of certain findings in Fritz v. The Court shall GRANT-IN-PART and DENY-IN-PART WITHOUT PREJUDICE Plaintiffs' #46 Motion. Plaintiffs' counsel shall be permitted access to Courtroom 28A on SEPTEMBER 4, 2018, from 11:30 AM until 1:00 PM, in order to take measurements for this exhibit. However, the Court shall refrain from authorizing use of this exhibit at trial and coordination with the Clerk's Office regarding the same until further pretrial proceedings make the merits clearer. July 17, 2018 Opinion or Order MINUTE ORDER: The Court held a teleconference on the record with Plaintiffs on July 17, 2018, in preparation for the three-day nonjury trial scheduled to begin on December 3, 2018. In their pretrial briefing, Plaintiffs had proposed that bellwether proceedings in this case consist of liability and damages determinations. The Court has decided that because of unique issues in this case, the determinations regarding bellwether attacks should instead be divided into so-called Phase I and Phase II. Among the unique issues dictating this decision, some of the information that ordinarily would be presented in damages proceedings will be presented in Phase I. The Court discussed with Plaintiffs the manner in which the Court expects to conduct Phase I proceedings in December 2018; the anticipated tasks for the special master in Phase II that would result in a report and recommendation to the Court; and the possible way in which non-bellwether proceedings could unfold thereafter.Plaintiffs shall submit revised pretrial materials that reflect the Court's discussion in this teleconference by AUGUST 30, 2018. Topics covered shall include, but not be limited to, the following aspects of Phase I proceedings: the number of attacks that Plaintiffs will present; the number and characteristics of Plaintiffs who were affected by those attacks; the identities of Plaintiffs who will testify regarding those attacks; the identities of experts that Plaintiffs will call; and the substance of any pretrial motions that Plaintiffs will file. June 18, 2018 Opinion or Order MINUTE ORDER: The Court has reviewed Plaintiffs' #42 Status Report, #43 Pretrial Brief for Liability Hearing, and #44 Pretrial Brief for Damages Hearing. The Court hereby schedules a nonjury trial with Plaintiffs from DECEMBER 3, 2018, through DECEMBER 5, 2018, regarding jurisdiction and bellwether liability. In the event that Plaintiffs establish liability, the Court may address bellwether damages during the trial or may defer damages in entirety to one or more special masters.In the interest of an efficient trial, the Court sets the following further deadlines. By OCTOBER 1, 2018, Plaintiffs shall submit revised lists of proposed fact and expert witnesses for both liability and damages. These lists shall be narrowed in comparison with the #42 Status Report in light of the subset of bellwether attacks that Plaintiffs have chosen to present. These lists also shall describe, with greater specificity than the #42 Status Report and #43 #44 Pretrial Briefs, the anticipated content of the proposed fact witness testimony, and shall supplement, as needed, the anticipated content of proposed expert testimony. Any revisions to the exhibit list contained in the #42 Status Report also shall be submitted by OCTOBER 1, 2018. By OCTOBER 15, 2018, Plaintiffs shall file under seal the documents that they have proposed in their #42 Status Report to so file.
