June 14, 2017 Opinion or Order MINUTE ORDER. The Court held a Fairness Hearing on the proposed class settlement in this matter on May 22, 2017. No class members appeared at the hearing to object. However, the parties informed the Court that four class members had not yet been given notice of the settlement. Accordingly, the Court ordered Plaintiffs to file a notice by no later than May 31, 2017, informing the Court as to their progress in giving notice to these class members and indicating the class members' position on the settlement. The parties filed a #39 Joint Notice of Status of Settlement on May 31, 2017, indicating that all four newly discovered class members were given notice, but that as of that time only two of the individuals had confirmed that they had no objections to the settlement. The Court ordered Plaintiffs to file another notice by no later than June 14, 2017, informing the Court as to their progress in giving notice to these class members and indicating the class members' position on the settlement. The parties then filed a #40 Joint Notice of Status of Settlement on June 14, 2017, indicating that another of the four class members had confirmed that he had no objections to the settlement. However one final class member has indicated that she wants to opt out of the class, although she has not filed an opt out notice and has not indicated that she objects to the settlement. The parties shall reach out to this individual again and explain to her that she must opt out or she will be part of the class. Under the terms of the Notice, this individual has until Friday, June 23, 2017 to opt-out and/or object to the settlement. The parties are ORDERED to file another notice, on Monday, JUNE 26, 2017, indicating whether this individual has opted out and/or objected to the settlement.
