May 8, 2018 Opinion or Order MINUTE ORDER directing Plaintiff Vantage Commodities Financial Services I, LLC, to SHOW CAUSE why this case should not be dismissed for lack of subject matter jurisdiction. "[T]here is a presumption against the existence of diversity jurisdiction." Naartex Consulting Corp. v. Watt, 722 F.2d 779, 792 (D.C. Cir. 1983). As the party invoking diversity jurisdiction, Plaintiff "bears the burden of pleading the citizenship of each and every party to the action." Id. For purposes of determining diversity jurisdiction, "[u]nincorporated associations, including LLCs, have the citizenship of each of their members." CostCommand, LLC v. WH Admins., Inc., 820 F.3d 19, 21 (D.C. Cir. 2016). Plaintiff has not made any allegations regarding its own citizenship or the citizenship of the other unincorporated parties and therefore has not established diversity jurisdiction. Accordingly, this case will be dismissed unless Plaintiff submits a supplemental filing demonstrating diversity of citizenship among the parties by May 22, 2018. SO ORDERED. Signed by Judge Trevor N. McFadden on 5/8/18. (lctnm1)
May 2, 2018 Opinion or Order MINUTE ORDER granting Defendants' #58 , #59 , #60 , #62 Motions to Stay Discovery. "It is well settled that discovery is generally considered inappropriate while a motion that would be thoroughly dispositive of the claims in the Complaint is pending." Loumiet v. United States, 225 F. Supp. 3d 79, 82 (D.D.C. 2016). In this case, there are pending motions to dismiss that would be thoroughly dispositive: If correct, the arguments in these motions would lead to dismissal of the entire Complaint since they allege deficiencies with respect to each claim that could not be cured by amendment. Plaintiff has failed to show that it would be prejudiced by a stay and has failed to indicate what jurisdictional discovery it desires or what facts it believes such discovery would reveal. Accordingly, discovery in this action is stayed until the decision of the pending motions to dismiss. SO ORDERED. Signed by Judge Trevor N. McFadden on 5/2/18. (lctnm1)
