May 12, 2023 Opinion or Order MINUTE ORDER denying as moot #110 Motion for Reconsideration and Motion to Stay. On August 10, 2022, the Court ruled, pursuant to the apex doctrine, that any request to depose FBI Director Christopher Wray or former President Donald J. Trump must await the completion of the depositions of former FBI Deputy Director Bowdich and former Deputy Attorney General Rod Rosenstein. Thereafter, on February 23, 2023, after full briefing by the parties as to what had transpired in those proceedings, the Court issued a lengthy oral ruling on the question of whether the depositions of Director Wray and former President Trump could proceed. It ordered in its discretion and in accordance with the applicable law that they could both go forward under very strict restrictions as to time and subject matter. The Court is somewhat surprised to learn that since then, the parties have done nothing more than wrangle over the order of the two depositions. The government seems chagrined that the Court did not order that the deposition of the FBI Director be completed first, but it may recall that it was the Court's view that it was Director Wray, the only current high-ranking public official in the group of proposed deponents, whose ongoing essential duties fell most squarely under the protection of the doctrine in question. The defendants' instant motion repeats arguments that were made and fully considered before, and it does not set forth grounds warranting reconsideration. The Court's ruling was appropriate in light of all of the facts, including the former President's own public statements concerning his role in the firing of the plaintiff. However, in order to get the parties -- who apparently still cannot agree on anything -- over this impasse, it is hereby ORDERED that the deposition of Christopher Wray proceed first, rendering the instant motion moot. With respect to the parties' discovery dispute that was brought to the Court's attention in accordance with the procedure sent out in the Scheduling Order, and after, considering the information provided by both parties, the Court has determined that no conference is necessary. It is ordered that the plaintiffs may reopen the deposition of former Associate Deputy Attorney General Scott Schools and question him for up to 70 minutes concerning the topics and documents that were previously designated as privileged. If the plaintiffs choose to devote some portion of that time to newly produced records, they may do so, but the Court is not ruling that the ongoing production of additional responsive records by either party is enough by itself to support a request by the opposing party to reopen a deposition absent extraordinary circumstances presented by a particular document or set of documents. February 23, 2023 Opinion or Order MINUTE ORDER. For the reasons stated on the record at the hearing on February 23, 2023, the #75 Defendants' Motion to Quash Subpoena and for a Protective Order barring plaintiff Strzok's proposed deposition of FBI Director Christopher Wray on the basis of the apex doctrine, and the Defendants' Motion to Quash Subpoena and for a Protective Order, filed in the related case, 22-mc-27, also based on the apex doctrine, related to the subpoena issued by plaintiff Strzok to former President Donald J. Trump, were DENIED in part. The Court authorized the plaintiffs to conduct depositions of each witness that do not exceed two hours and are limited to the narrow set of topics specified on the record at the hearing. Today's ruling addressed the apex doctrine issues only and did not resolve any questions related to either the Presidential communications prong or the deliberative process prong of the executive privilege. For the reasons stated on the record, the government must inform the Court whether the current President will invoke the executive privilege with respect to the specified topics by March 24, 2023. Also, for reasons stated on the record at the hearing, the Court resolved several discovery disputes, and a status report on the state of discovery is due on March 13, 2023. The hearing was conducted under seal, but in accordance with the Court's 2/21/2023 Minute Order, and with the consent of the parties, the transcript of the proceedings will be unsealed with the limited exception of those portions of the apex doctrine discussion that made reference to sealed deposition testimony, and the portions of the hearing related to discovery disputes. August 10, 2022 Opinion or Order MINUTE ORDER. For the reasons stated during today's proceeding in 19-cv-2367, defendants' motion to quash the deposition notice and subpoena issued to FBI Director Christopher Wray #75 is GRANTED insofar as it asks for the depositions to be sequenced, but otherwise, it remains held in abeyance. The motion to quash the deposition and subpoena as to former President Donald J. Trump in the related case, 22-mc-27, is also GRANTED in terms of the sequencing of depositions, but otherwise held in abeyance. The deposition of the former FBI Deputy Director David Bowdich must be completed before the challenged depositions, along with the deposition of former Deputy Attorney General Rod Rosenstein, which has already been scheduled. On September 29, 2022, both parties must file supplemental pleadings, which may be no longer than four pages, addressing whether and how any information gathered in those depositions bears upon the resolution of the apex doctrine issue raised in the motions to quash. Furthermore, in order to address the questions of executive privilege that bear upon the resolution of the motions, plaintiff must file a notice by September 29, 2022 transmitting a transcript of the Rosenstein deposition and listing, with as much particularity as possible, the subject matter areas and substance of the questions he would propose to ask at any deposition of the former President and the FBI Director. The defendants must respond to that notice by October 14, 2022, identifying all questions to which they intend to assert executive privilege, specifying as to each whether they are asserting the Presidential Communications or deliberative process prong of the privilege (or both). Neither the September 29 nor the October 14 submission may include any additional commentary or argument with respect to relevance or the apex doctrine. Finally, on October 28, 2022, the parties must submit simultaneous briefs, which may not exceed 15 pages, setting forth their legal arguments as to applicability of the executive privilege. For the reasons stated on the record at the hearing, the Court also resolved a series of outstanding discovery disputes. The government must produce the text messages identified or collected during the Office of the Inspector General's Midyear Investigation Review that were considered to be "inappropriate" but were not referred to the FBI Office of Professional Responsibility for possible discipline; the names of the employees involved may be redacted. The government must also produce the requested December 12, 2017 phone logs for the officials identified in Request No. 47 which may be redacted to exclude inter- or intra-agency calls or external personal calls not directed to any member of the press or media; the log of Sarah Isgur's calls must be produced for the entire eleven day period identified by plaintiff. The remaining discovery disputes were rendered moot by the Court's rulings on the motions to quash and the schedule of future depositions and privilege briefings. While the Court understands the plaintiffs' interest in bringing discovery to a close, the parties' original proposed schedule was ambitious, and one cannot ignore the fact that the discovery period has overlapped with a time in which government operations of every sort have been burdened and delayed by the pandemic. Moreover, plaintiffs themselves bear some responsibility for the need for additional time if they are still naming additional potential records custodians. Therefore, after considering the parties' representations in the joint status report #70 , the Court finds the following schedule to be appropriate: plaintiffs must make any requests to expand the search to include additional custodians by December 1, 2021. On April 26, 2021, the Court conducted a status conference in the Strzok case, 19-cv-2367, to resolve several disputes concerning the scope and timing of discovery related to Counts One and Two, which arise out of plaintiff's termination. The parties advised the Court that they had resolved the issue concerning the production of records of potentially comparable disciplinary actions, so the Court did not rule on that issue further. The Court agreed with the defendant that it need not provide the metadata associated with every record produced, but it will be required to produce it if the plaintiff raises a good faith concern about the authenticity or provenance of a document or whether the document has been altered in some way. The parties must meet and confer about the format of the information if that situation arises. Defendant must identify the custodian who was the source of any records produced, but it need not identify potential custodians who searched records in their possession but found but no responsive documents. Defendant may not redact the identity of people who are in the "to" or "from" line of e-mails; if it concludes that it is appropriate to redact the names of GS level employees named as "cc's" on any communication, the parties must meet and confer before bringing that dispute to the Court. The Court notes, though, that there is a Protective Order in place that may alleviate the government's concerns regarding any sensitive material. The date for the completion of all discovery related to plaintiff Strzok's constitutional claims is hereby extended until October 15, 2021; in order to meet that deadline, records responsive to his requests for production must be produced by September 1.
