MINUTE ORDER: The Court is in receipt of Plaintiffs' #30 Status Report, in which Plaintiffs again represent that they would not oppose the Court sua sponte dismissing this action. Pursuant to 11 U.S.C. 362, this matter nevertheless remains stayed, so Plaintiffs must first request that the United States Bankruptcy Court for the Northern District of Texas terminate the automatic stay governing this case. As such, and per the Court's February 10, 2023 minute order, this case remains stayed, and Plaintiffs shall file a status report on or before January 7, 2024 and, if necessary, every sixty days thereafter. MINUTE ORDER: The Court is in receipt of Plaintiffs' #29 Status Report, in which Plaintiffs indicate that they "have no objection to the Court dismissing this action without prejudice." Because a counterclaim was filed against Plaintiffs by Defendants, currently in bankruptcy, the Court is concerned that Plaintiff has not yet shown "terms that the [C]ourt considers proper" to dismiss the action without prejudice. See Fed. R. Civ. P. 41(a)(2). Accordingly, the Court's August 18, 2023 minute order directing intermittent filing of status reports stands unless and until Plaintiffs move for relief therefrom.
