MINUTE ORDER re #4 Amended Motion for Temporary Restraining Order and Preliminary Injunction: Defendant has not yet filed an appearance in this case. To the extent that the Amended Motion is intended as an ex parte application for a TRO, the Court DENIES that Motion because Plaintiff has not demonstrated an emergency that would justify that exceptional relief. See Local Civil Rule 65.1(a). Having denied ex parte relief and carefully reviewed the Amended Motion, the Court finds that there will be no prejudice to the Parties should the Court wait to schedule a hearing as to the requested injunction until Defendant makes an appearance in the case.
