MINUTE ORDER: Upon consideration of #15 Advocacy Holdings' Second Expedited Motion to Extend Temporary Restraining Order, it is hereby ORDERED that the Motion is DENIED without prejudice. Advocacy Holdings has moved to extend the TRO initially issued by this Court on May 19, 2023, see Case No. 23-cv-1176 (D.D.C.), ECF 35, for a second time. Clevinger opposes the extension. ECF 16. The Court denies Advocacy Holdings' Motion because it believes that a TRO cannot remain in place more than 28 days without the consent of the enjoined party. See, e.g., Costa v. Bazron, No. 19-3185, 2020 WL 2410502, at *4 (D.D.C. May 11, 2020); see Sampson v. Murray, 415 U.S. 61, 86 (1974). If Advocacy Holdings has authority to support its request for a second, opposed extension, it may provide authority that satisfies the Court that it can extend the TRO beyond 28 days without the consent of Clevinger. The Court reminds the Parties that they are scheduled to appear before the Court for a Preliminary Injunction Hearing on July 6, 2023. In the event that the Parties would like to accelerate dates, the Court is available to conduct a Preliminary Injunction Hearing in advance of July 6, 2023.Signed by Judge Jia M.
