Filing 13 ENDORSED ORDER. Before the Court is Plaintiff's Notice of Settlement and Response to DE 11. (Doc. #12). Because the parties have reached a settlement, the Court will administratively close the file and dismiss the case without prejudice. See M.D. Fla. R. 3.08(b). Accordingly, it is ORDERED that this case is DISMISSED without prejudice subject to the right of any party within thirty days from the date of this Order, December 3, 2020, to submit a stipulated form of final judgment or request an extension of time to do so, or for any party to move to reopen the case upon a showing of good cause. See M.D. Fla. R. 3.08(b). Once the thirty-day period expires, this dismissal will be deemed with prejudice without further order. The Clerk is DIRECTED to terminate all deadlines, deny as moot any pending motions, and administratively close the case. Signed by Judge Sheri Polster Chappell on 11/3/2020. (CMC) |

Filing 11 ENDORSED ORDER directing the parties to jointly notify the Court on or before November 3, 2020, why Defendant has not answered the Complaint or moved for an extension of time to do so by October 30, 2020 per the Court's Order. (Doc. 10). Failure to do so may result in the Court dismissing this case for failure to prosecute and/or failure to follow the Court's orders. Signed by Judge Sheri Polster Chappell on 11/2/2020. (CMC) |
Filing 10 ENDORSED ORDER. The Court will take no further action on its Order (Doc. 6) based on Plaintiff's Response to Order to Show Cause. (Doc. #9). But deadlines are not mere suggestions and must be strictly followed. If parties need more time to comply with a deadline for settlement discussions, then they still must ask the Court to extend the due date. That said, the Court extends the deadline for Defendant to answer the Complaint to on or before October 30, 2020. Signed by Judge Sheri Polster Chappell on 10/16/2020. (CMC) |
