Filing 12 ENDORSED ORDER: On July 22, 2019, this Court ordered Plaintiff to show cause why this case should not be dismissed for failure to prosecute in light of Defendants' failure to timely file a response to the Complaint, which was due July 18, 2019, and Plaintiff's subsequent failure to promptly apply for entry of Clerk's default. (Doc. # 10). Counsel for Plaintiff responded that he did not move for a Clerk's default because he had been contacted by an attorney who purported to represent both Defendants in this case and who said that he would be filing a responsive pleading in this matter. (Doc. #11). A review of the docket reveals that a response to the Complaint has still not been filed, counsel has not appeared on Defendants' behalf, and Plaintiff has not moved for entry of Clerk's default. Accordingly, Plaintiff is directed to show cause by July 26, 2019, why this action should not be dismissed for failure to prosecute pursuant to Local Rule 3.10(a). Signed by Judge Virginia M. Hernandez Covington on 7/24/2019. (MWS) |

Therefore, Defendants' response to the Complaint was due on July 18, 2019. But no response has been filed and Bluewater has not promptly applied to the Clerk for entry of default pursuant to Local Rule 1.07(b). Accordingly, Bluewater is directed to show cause by July 25, 2019, why this action should not be dismissed for failure to prosecute pursuant to Local Rule 3.10(a). Signed by Judge Virginia M. Hernandez Covington on 7/22/2019. (MWS) |
Filing 9 ENDORSED ORDER:: Counsel are directed to meet and confer, in person or by telephone, and by August 1, 2019, file a completed Case Management Report. This document can be found on Judge Covington's page of the Court's website at www.flmd.uscourts.gov. Please be advised that the Court's Case Management Report form is different from those used by other judges. Local Rule 3.05(c)(2)(E), M.D. Fla., explains that most track two cases, like the present case, "will be tried within one year after the filing of the complaint." To accomplish this goal, the Court believes that six to eight months is a sufficient period of time to conduct discovery. If the parties believe that more time than eight months will be needed to complete discovery, the parties should provide the Court with a detailed explanation as to why additional time is needed and a timeline for the discovery that is planned. The Court will then determine whether a Case Management Hearing is necessary before entry of a Case Management and Scheduling Order. Signed by Judge Virginia M. Hernandez Covington on 7/5/2019.
