May 28, 2021 Opinion or Order Filing 4 ENDORSED ORDER: On May 28, 2021, Defendant Electric Insurance Company removed the case to this Court on the basis of diversity jurisdiction. (Doc. #1). However, the Complaint does not specify the amount of damages sought, and when "damages are unspecified, the removing party bears the burden of establishing the jurisdictional amount by a preponderance of the evidence." Lowery v. Ala. Power Co., 483 F.3d 1184, 1208 (11th Cir. 2007). Electric Insurance argues that damages exceed $75,000 due to Plaintiff Tara Iglinski's past medical bills "of over $32,000," her demand for $500,000, and her treating doctrine opining that "her future medical care would cost $158,064.00" (Doc. #1 at 2-3). But, Electric Insurance provides no concrete facts supporting the contention that Iglinski's damages exceed $75,000 other than the past medical bills "of over $32,000." (Id.). Accordingly, Electric Insurance is directed to provide the Court with more information by June 4, 2021, regarding the amount of damages in order to establish that the amount in controversy has been satisfied.
