Midland is discharged of all liability to any person for the lif e insurance proceeds at issue, Policy No. 1502671621, now deposited in escrow, and the defendants and any person claiming through them or for their benefit are permanently enjoined from commencing or prosecuting any proceeding or claim against Midlan d with respect to the insurance proceeds payable under Policy No. 1502671621. (b.) Midland is dismissed from further participation in this lawsuit, however, dismissal shall be without prejudice to any claims arising out of the change of ownership for m which do not involve the proceeds of the insurance policy. (c.) Midland's request for costs and attorney's fees is denied. (2.) Fredricksen's motion for leave to amend her answer (doc. 53 ) is DENIED. (3.) Pursuant to Rule 54(b) of the Federal Rules of Civil Procedure, this decree is a final judgment as to Midland National Life Insurance Company and the court determines that there is no just reason for delay.
