Filing 9 ORDER. Plaintiff's motion of clarification, ECF No. #8 , is GRANTED. The Clerk of Court shall prepare and complete USM-285 forms, waiver of service forms (NUSM-1 waiver form), and two AO-399 forms for Defendant Officer D. Miller, #375. The Clerk of Court shall provide the prepared forms along with a copy of this Order for the Defendant, and the service copy of the complaint (ECF No. #1 ) to the United States Marshals Service (USMS). Pursuant to Fed. R. Civ. P. 4(c)(3), service shall be made by the USMS and the costs of such service is advanced by the United States. The Clerk of Court shall refer this file if a waiver form is returned for insufficient address or for similar reason, if service on the Defendant is returned unexecuted, or if the USMS has filed a statement of costs incurred for making personal service. Defendant Miller shall have 60 days in which to file a response to the complaint if the waiver form is returned to the Court within 30 days. Counsel for Defendant Miller shall file a notice of appearance within twenty (20) days of the date of service or waiver of service. After a response to the complaint has been filed, any paper submitted for filing which does not contain a certificate of service shall be returned by the Clerk and disregarded by the Court. In accordance with 28 U.S.C. 636(c)(2), the Clerk shall forward to Plaintiff a form for consenting to trial by the magistrate judge, with the case number written on it. The Clerk shall refer this file upon the filing of a waiver form, a notice of appearance, an answer or other response to the complaint, or no later than February 10, 2020. Plaintiff has until 12/23/2019, to file a response to this Order which clarifies the basis for his current incarceration. Should Plaintiff desire to eliminate the false arrest claim raised in the initial complaint, Plaintiff shall have until 12/23/2019, in which to file an amended civil rights complaint. If Plaintiff does not want to continue this case, a Rule 41(a) notice of voluntary dismissal must be filed by the same deadline.
