Filing 5 Partial Filing fee: $ 26.73, receipt number FLN3-12756. (mlp) |
ACTION REQUIRED BY MAGISTRATE JUDGE: Chambers of MAGISTRATE JUDGE MICHAEL J FRANK notified that action is needed Re: 5 Filing Fee Received as per #4 Order. Referred to MICHAEL J FRANK. (mlp) |
Filing 4 ORDER re #2 is GRANTED to the extent that the case may proceed without prepayment of the entire filing fee. The clerk of court shall assess Plaintiff $26.73 as an initial partial filing fee as provided in 28 U.S.C. 1915(b)(1)(A). The total filing fee for this case remains $350.00. Plaintiff shall have THIRTY (30) DAYS from the date of docketing of this order in which to submit the initial partial filing fee as assessed by the clerk of court. After payment of the initial partial filing fee, Plaintiff shall be required to make monthly payments of 20 percent of the preceding months income (that is, all funds deposited into his inmate account) in each case he has filed in this court. The clerk of court is directed to MAIL a copy of this order, with the appropriate cover letter to: Department of Corrections, 501 South Calhoun St., Tallahassee, FL 32399-2500, Attention: Agency Clerk. No further action shall be taken with regard to Plaintiffs claims until the initial partial filing fee is received. Plaintiffs failure to submit the partial filing fee as instructed likely will result in dismissal of this action and Plaintiffs inability to proceed in forma pauperis in future actions. Plaintiff is warned that he is ultimately responsible for payment of the filing fee should the agency with custody over him lapse in its duty to make payments on his behalf. Finally, Plaintiff is advised that dismissal or other disposition of this action will NOT relieve him of the obligation to pay the full filing fee in this case. In accordance with 28 U.S.C. 636(c)(2), the clerk of court shall forward to Plaintiff a form for consenting to have a United States Magistrate Judge handle proceedings in this action, with the case number written on it. Signed by MAGISTRATE JUDGE MICHAEL J FRANK on 3/4/19. Fee status updated. (Fee due by 4/3/2019.). Forms mailed to Plaintiff and Florida Department of Corrections, Agency Clerk as directed. (mlp) |
