February 27, 2019 Opinion or Order Filing 20 PAPERLESS ORDER. THIS CAUSE is before the Court on a sua sponte examination of the record. On February 21, 2019, this Court ordered Plaintiff and Defendant to show cause by February 26, 2019 why these cases--Crocciolla v. Stryker Corporation (0:18-cv-62874-KMM) and Crocciolla v. Howmedica Osteonics Corp (0:19-cv-60069-KMM)--should not be consolidated for all purposes, including trial. 16 . Plaintiff responded to the order to show cause stating that Plaintiff did not object to the consolidation of the cases. #17 . Defendant did not file a response and the time to do so has passed. Federal Rule of Civil Procedure 42(a) allows the Court to consolidate actions having common questions of law or fact. Here, two cases brought by the same Plaintiff against one of the same Defendants--Crocciolla v. Stryker Corporation (0:18-cv-62874-KMM) and Crocciolla v. Howmedica Osteonics Corp (0:19-cv-60069-KMM)--have common questions of law and fact. The Court concludes that consolidation is appropriate. Accordingly, UPON CONSIDERATION of the Response, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the above-referenced cases are CONSOLIDATED for all purposes, including trial. The Clerk of Court is instructed to administratively CLOSE the higher-numbered action. Crocciolla v. Howmedica Osteonics Corp (0:19-cv-60069-KMM) is consolidated with the lead case, Crocciolla v. Stryker Corporation (0:18-cv-62874-KMM). Any motions pending in the closed case are DENIED AS MOOT. The Parties are instructed that all FUTURE FILINGS MUST BE MADE in the lead case, Crocciolla v. Stryker Corporation (0:18-cv-62874-KMM). Plaintiff shall FILE an Amended Complaint in the lead case that reflects the consolidated nature of this action on or before March 11, 2019.
