Date Filed Document Text
August 6, 2019 Opinion or Order Filing 11 PAPERLESS ORDER denying without prejudice #10 Motion to Continue Trial Date. On August 1, 2019, the Court scheduled this matter for trial during the two-week trial period commencing May 11, 2020. (DE #8 ). Plaintiffs now seek to continue the trial date because their counsel has another trial scheduled before Judge Robin L. Rosenberg, Case No. 19-80884-RLR, during the same two-week trial period. While the Court appreciates that counsel has another matter pending, it is not uncommon in litigation for schedules to change and for cases to settle without need of a trial. At this stage, based upon the one relevant conflict identified, the Motion to Continue Trial is denied as premature. If necessary, I will revisit the issue of actual scheduling conflicts closer to the time of calendar call, which is set before this court on May 6, 2020. Signed by Judge Donald M. Middlebrooks on 8/6/2019. (sfr)
