ORDER GRANTING in part and DENYING in part 18 Motion for Summary Judgment. The Defendant is entitled to summary judgment on the Plaintiff's request for punitive damages but is not entitled to summary jud gment on her negligence claim. The Plaintiff is ORDERED to show cause within 14 days why summary judgment should not be granted on her request for attorneys' fees. The Plaintiff shall also address whether she can recover damages for "mental pain and suffering" in this action for negligence. The Defendant will have 7 days to respond.
