January 7, 2010	Filing 30 ORDER and OPINION Reversing and Remanding the decision of the Commissioner. The Clerk is DIRECTED to enter judgment accordingly. In the event that benefits are awarded on remand, Plaintiff's attorney may file a motion for approval of attorney� 39;s fees under 42 U.S.C. §§ 406(b) and 1383(d)(2) no later than 30 days after the date of the Social Security letter sent to Plaintiff's counsel of record at the conclusion of the Agency's past-due benefit calculation stating the amount withheld for attorney's fees. Defendant's response, if any, is due no later than 30 days after Plaintiff's attorney serves the motion on Defendant. Plaintiff shall file any reply within 10 days of service of Defendant's response.
