The 97 Motion is DENIED as to Counts III, IV, VII, VIII, and XI for all MD Planning Group Defendants and as to Count VI for Defendants Physicians Planning Group, LLC, MD Planning Group, LLC, and Main Street Investment Management, Inc. Counts I and II of Plaintiffs' 41 Complaint are DISMISSED as to Defendants John Redfearn, Ron Lundy, Jeffrey Nesseth, Physicians Planning Group, LLC, MD Planning Group, LLC, and Main Street Investment Management, Inc., and Count VI is DISMISSED as to Defendants John Redfearn, Ron Lun dy, and Jeffrey Nesseth. As required by the October 1, 2009 114 Order, the parties shall confer and endeavor to reach agreement on a proposed discovery scheduling order. In the event the parties are unable to reach agreement within seven days of the entry of this Order, each party may submit a proposed discovery scheduling order within fourteen days of the entry of this Order.
