August 30, 2010	Filing 13 FINAL OPINION AND ORDER Reversing and Remanding the decision of the Commissioner. The Clerk is DIRECTED to enter judgment in favor of the Plaintiff. IT IS FURTHER ORDERED that, in the event that past due benefits are awarded to the Plaintiff upon rem and, Plaintiffs attorney may file a motion for approval of attorneys fees under 42 U.S.C. §§ 406(b) and 1383(d)(2) no later than thirty days after the date of the Social Security letter sent to Plaintiffs counsel of record at the conclusion of the Agencys past-due benefit calculation stating the amount withheld for attorneys fees. Defendants response, if any, shall be filed no later than thirty days after Plaintiffs attorney serves the motion on Defendant.
