ORDER granting Plaintiff's 28 Motion for Partial Summary Judgment. Defendant's 32 Motion for Summary Judgment is GRANTED in part and DENIED in part. It is GRANTED as to Plaintiff's statutory claim for bad faith penalties and atto rney fees but DENIED as to Plaintiff's claim for benefits under the Policy. In light of these rulings, Defendant is ORDERED TO SHOW CAUSE within fourteen days of the date of entry of this Order why its Counterclaim should not be dismissed. Signed by Judge Richard W.
