It is DISMISSED AS MOOT as to the plaintiff's claims against CSX Transportation, Inc. due to notice of settlement of the claims against CSX Transportation, Inc. filed by the plaintiff [Doc. No. #25 ]. The clerk is DIRECTED to administratively close this action. However, either the plaintiff or CSX Transportation, Inc. may re-open the case within sixty (60) days of the date of this order if settlement between those two parties is not consummated..
