October 23, 2019 Filing 54 NOTICE Setting Hearings: The Court sets a status hearing to begin at 9:30 a.m. before the Honorable William M. Ray, II on the following dates: Friday, February 7, 2020, Friday, March 6, 2020, Friday, April 24, 2020, Friday, June 5, 2020, Friday, July 10, 2020, Friday, August 7, 2020, Friday, September 4, 2020 and Friday, October 2, 2020 in Courtroom 1705, Richard B. Russell Federal Building, 75 Ted Turner Drive, SW, Atlanta, Georgia 30303. Signed by Judge William M. Ray, II on 10/23/2019. (jed)
October 23, 2019 Filing 53 Minute Entry for proceedings held before Judge William M. Ray, II: Motion Hearing held on 10/23/2019 re #3 MOTION for Protective Order and MOTION for Leave to Proceed Anonymously. MOTION Hearing set for 11/25/2019 at 09:00 AM in ATLA Courtroom 1705 before Judge William M. Ray II. The Court discussed the motion to transfer cases pending in the Jane Doe 2 & 3 cases. As there are no objections, Judge Ray will contact the other judges to seek a re-assignment (not consolidation) of these related cases. Parties discussed a forthcoming amended complaint and revised proposed protective order. The Court stated it will not rule on the #3 motion yet, but that if parties have not resolved it within 6 months of its filing date, the Court will deny it as moot. Parties advised the motion for protective order should be resolved promptly and the motion for more definite statement would be mooted by an amended complaint. Parties are in consent about additional time for Plaintiff to amend the complaint and adhere to the same time frame as the other Doe cases. The Court will enter the scheduling order as proposed. The Amended Complaint is due by 11/21 and the Answer is due within 21 days thereafter; Initial Disclosures due 12/16; written discovery begins 1/1/20; depositions begin 3/1/20; expert witnesses disclosed by 9/1/20; discovery will end 10/31/20 and summary judgment motions due 11/30/20. The Court cautioned counsel about the need for pushing this case forward in a timely manner. Plaintiffs seek 6 months for discovery; Defendants do not think this is unreasonable but as the identities of the Plaintiffs are still concealed, they cannot agree at this time and argue more than 6 months may be needed. The Court will allow 8 months of discovery. Parties are directed to file any additional/ revised motions for protective order by next Monday; oral argument will occur on Monday, November 25th at 9:00 AM unless the motion is resolved by parties prior. (Court Reporter Wynette Blathers) (jed) (Court Reporter Wynette Blathers)(jed) Modified on 10/23/2019 to change discovery from 10/30 to 10/31 (jkl).

The hearing on the pending Motion for Protective Order and Motion for More Definite Statement will stay on the calendar as originally scheduled. The Court is willing for counsel to arrange with the technology personnel at the Court such that Attorney Turner can appear telephonically to listen in on the hearing, but any argument made on behalf of Defendant Choice Hotels International, Inc. must be made by local counsel who will be present in the courtroom. The Court remains willing to reschedule the hearing to either Monday, October 21, 2019 or Tuesday October 22, 2019, if that will accommodate Attorney Turner's appearance. If counsel for the parties can agree to an alternative time on either of these dates, counsel should immediately notify the Court. Absent notification that the parties have agreed to move the date and time of the hearing, it will remain as scheduled. Signed by Judge William M. Ray, II on 10/17/19. (ddm)
