IT IS RECOMMENDED that: (a) the United States' Petition to Enforce Internal Revenue Service Summons #1 be GRANTED; (b) Respondent Melissa Hoppie be ORDERED to appear before Revenue Officer Mindy Richardson within thirty (30) days of the date of the District Court's order granting the United States' Petition to Enforce Internal Revenue Service Summons, and fully comply with the Summons at that time. Respondent should be admonished that failure to comply with the IRS Summons and Court Order could result in a finding that she is in contempt of court. As this is a Final Report and Recommendation, there is nothing further in this action pending before the undersigned. Filing 5 ORDER: This matter is set for a hearing on September 19, 2023 based on the Court's Order to Show Cause, August 9, 2023 #2 . In that Order, the Court required Respondent to file and serve a responsive pleading at least seven days in advance of the hearing in order to preserve and assert any defenses to enforcement of the IRS Summons in this case. The Government has filed a Notice #4 on September 15, 2023, stating that no such written response has been filed or served, and the Government further suggests that the Court take the September 19 hearing off the calendar and issue a Report and Recommendation that would recommend granting the petition. Indeed, the Court's Order to Show Cause had indicated that if no written response were to be filed, the Court could cancel the show-cause hearing and proceed to issue a recommendation in favor of the Government. See Order #2 7. However, given that Respondent will not receive electronic notification of either the Government's Notice or any Order by the Court issued today and may not as a practical matter receive any mailings from the Government or the Court until after the hearing date, the Court finds it most appropriate to keep the hearing on the calendar. At such hearing, to the extent Respondent appears and opposes the petition, Respondent's first burden will be to explain why such opposition was not waived by the failure to comply with the requirement to file a written opposition to the Order to Show Cause.
