April 24, 2019 Filing 6 EO: On April 22, 2019, Plaintiff Lokelani V. Costales ("Plaintiff") filed a #5 Motion for Entry of Default against Defendant City and County of Maui Parks and Recreation ("Motion"), requesting entry of default against the City and County of Maui Parks and Recreation ("County") for failure to respond or reply to Plaintiff's March 22, 2019 Complaint. It appears that the Complaint was served on March 27, 2019, to William H. Amural Jr, Maui Department of Parks and Recreation's East Maui District Superintendent. See ECF No. 4. The Court finds that Plaintiff's service was improper because Plaintiff failed to effect service on the County in accordance with Federal Rule of Civil Procedure 4(j)(2). Rule 4(j)(2) provides that a state, a municipal corporation, or any other state-created governmental organization that is subject to suit must be served by: (A) delivering a copy of the summons and of the complaint to its chief executive officer; or(B) serving a copy of each in the manner prescribed by that state's law for serving a summons or like process on such a defendant. Plaintiff fails to meet the requirements of Rule 4(j)(2). First, the County does not have a chief executive officer. Second, Hawaii Rules of Civil Procedure ("HRCP") requires that the summons and complaint be served on a county, as provided by statute or the county charter, or "by delivering a copy of the summons and of the complaint to the corporation counsel or county attorney or any of his or her deputies." Haw. R. Civ. P. 4(d)(6). HRCP also requires that service upon an agency of a county be made by serving the county and by delivering a copy of the summons and of the complaint to such agency. Accordingly, Plaintiff must (1) effect service as provided by statute or county charter, and/or (2) deliver "a copy of the summons and of the complaint to the corporation counsel or any of his or her deputies" at the Department of the Corporation Counsel for the County of Maui and also, deliver a copy of the summons and of the complaint to Maui's Parks and Recreation to properly effect service. Plaintiff is encouraged to consult the HRCP for further guidance. See LR83.13 ("Pro se litigants shall abide by all local, federal, andother applicable rules and/or statutes.")Because Plaintiff has not duly served the summons and Complaint on the County in accordance with the Federal and Hawaii Rules of Civil Procedure, entry of default judgment is not proper at this time.
