EO: Mr. Farrar's counsel is asked to file, no later than November 29, 2021, a statement that provides reasons that an evidentiary hearing is or is not being requested. If an evidentiary hearing is being requested, proposed witnesses should be listed in the statement. If an evidentiary hearing is requested by Mr. Farrar, the Government should notify this court by December 3, 2021, whether, if an evidentiary hearing is held, the Government proposes to call witnesses, and, if so, who those proposed witnesses are. If neither side identifies witnesses, this court will allow oral argument at a nonevidentiary hearing scheduled for December 14, 2021. If this court opts to hold an evidentiary hearing on December 14, 2021, the court will so inform the parties, who should arrange for witnesses to be present by video. (JUDGE SUSAN OKI MOLLWAY)(cib)
